Standard Self Parking Terms and Conditions (“the conditions”)

This is a legal document which contains contractual provisions. Your Statutory Rights are not affected.

1. Bookings

1.1 Bookings through the Secure Airparks website are deemed to be made when validated on the website.

1.2 Bookings made by telephone are deemed to be made when confirmed by a Secure Airparks telesales operator.

1.3 All services are subject to availability.

1.4 Secure Airparks reserve the right not to accept or fulfil a booking.

1.5 All tariffs include VAT and are on a per day basis (00:01 – 23:59). For example: Saturday to Saturday will be 8 days. If your return is delayed, you may incur extra charges. No refund will be made for unused days.

1.6 We recommend that you tell one of our staff, when you arrive at the car park, if you intend to leave your vehicle for longer than 28 days, or your plans change so that you would be so parked. Unless you tell us this, or you have pre-booked for longer than 28 days, we will be entitled to assume that your vehicle has been abandoned. Abandoned vehicles may be disposed of and we will recover the cost thereof from you.

1.7 We reserve the right to change our tariffs at any time and to withdraw any special rate. This will not affect any reservation made before the change. The applicable tariff will be shown on your booking confirmation.

1.8 We only accept bookings for cars and light vans. You are not entitled to a refund if your vehicle exceeds the size limits we impose. Please contact us if you wish to check whether your vehicle will be accepted.

1.9 When you book you may be required to specify the make, type, and registration number of the vehicle to which the booking relates. You may change these details at any time before you arrive at the car park, at no charge, by contacting us.

1.10 Our car parks have disabled spaces for use by blue badge holders, but unfortunately we cannot accept bookings specifically for disabled spaces. If you have any particular requirements, please contact a member of staff on arrival.

2. Payment

2.1 Payment for a booking made by telephone or on our website can be made using most debit or credit cards.

2.2 If payment by card is declined or if a payment cheque is returned uncleared Secure Airparks and the service provider reserve the right not to fulfil your booking.

2.3 All prices are quoted in pounds sterling including VAT.

2.4 When using a overseas credit card the card issuer will debit your account in your local currency at the exchange rate applicable on the date of processing. A conversion charge may be applicable.

2.5 Payment by cheque should be made to Secure Airparks, 100 Ingliston Road, Ingliston, Edinburgh, EH28 8AU (“the administration address”)

3. Cancellation

3.1 The customer may cancel a booking at any time if cancellation cover at £1.49 is selected at time of booking. Customer is entitled to full refund or credit.

3.2 No refunds or credits can be given unless cancellation cover is purchased.

3.3 Cancellations shall be in writing by post (to the administration address), or e-mail (see condition 8.7) to Secure Airparks.

4. Parking

4.1 Once you have booked and we have received payment for that booking, you are entitled to park the designated vehicle in our car park. The parking of your vehicle will be subject to these Conditions of Parking.

4.2 You must park your own vehicle and retain your keys. Parking is at your own risk. We cannot park your vehicle for you, nor look after your keys.

4.3 Unless specifically requested to do so by us or our employees, servants or agents you should not under any circumstances:

  • park in a no parking area
  • park on a double yellow line
  • park other than in a designated parking bay
  • park in a disabled bay without displaying the required ticket
  • park across two parking bays
  • park in a space that is marked as “reserved” without authorisation

4.3 All vehicles must be locked. We cannot assist you in gaining access to a locked vehicle if you do not have the keys. Tariffs continue to be charged until the vehicle is removed.

4.4 Whilst vehicles are insured when in our premises, no contract or deposit whether express or implied is entered into by Secure Airparks or its patrons.

4.5 During the Parking Period Secure Airparks shall keep the vehicle at its premises.

4.6.1 Any customer wishing to reclaim his vehicle prior to expiry of the agreed parking period will be liable to pay the parking fee for the whole of the agreed parking period.

4.6.2 Secure Airparks require no less than 2 hours notice to make a vehicle available for collection prior to the day of expiry of the agreed parking period.

4.7 Neither the customer nor any other person shall have the right to remove the vehicle or any other personal items therein prior to payment in full of the parking fee.

4.8 It is the duty of the customer to ensure that the vehicle is in a proper roadworthy condition prior to leaving Secure Airparks premises and entering onto the public highway.

4.9 A customer must produce the receipt provide by Secure Airparks when reclaiming the vehicle. In the event that a receipt is lost Secure Airparks shall be entitled to require proof of the customer identify.

4.10 Secure Airparks shall not be obliged to release the vehicle to a third party without the written authority of the customer.

4.11 In the event of a car being left for a long period of time without consulting Secure Airparks we may take ownership of the vehicle to recoup costs of car parking.

5. Customer’s Liability

5.1 The customer shall be liable for and indemnify Secure Airparks in respect of any death, personal injury or damage caused by the customer or any person with the customer whilst on Secure Airparks premises or in anyway arising from a breach of the warranty in paragraph 5.2 below.

5.2 The customer warrants to Secure Airparks that at the commencement of the parking period, the customer’s vehicle is in a safe and roadworthy condition, has a current MOT certificate (if required by law) and that no dangerous, toxic or illegal substances have been left within the vehicle.

5.3 Should you damage another vehicle or any part of a car park you must report the matter immediately to a member of our staff and give him or her the registration numbers of both vehicles together with your full name and address and the name and address of your insurance company together with your policy number. In doing so, for the purposes of the Data Protection Act 1998 and any other relevant law you are consenting to our passing this information on to the owner or driver of any other vehicle involved.

6. Transport to and from Airport

6.1 Transport between Secure Airparks premises and the airport on Secure Airparks vehicles is (subject to these conditions) included in the parking service.

6.2 Transport between Secure Airparks premises and the airport leaves at regular intervals to coincide with flight arrivals and departure times. It is the customer’s responsibility to arrive at Secure Airparks in good time (allowing for possible traffic congestion and other delays) to enable them to arrive at the airport by the airline’s recommended check in time.

6.3 Secure Airparks accept no liability for transport delays caused by traffic congestion, vehicle breakdown or other causes beyond Secure Airparks' control.

6.4 customers should not board a vehicle if they are unable to find a seat or if the maximum number of standing passengers (as displayed in the vehicle) have boarded.

6.5 Children under the age of 8 may only travel if seated.

6.6 No animal may be carried without prior agreement of Secure Airparks.

6.7 All travel luggage must be kept with the persons travelling or in the luggage storage areas on the vehicle and must not be placed in the aisles or standing areas.

6.8 The proprietors of Secure Airparks or their employees do not accept any liability for property breakages in the luggage compartment of the coaches howsoever caused, any breakable items should be retained inside the coach by patrons.

6.9 The driver is responsible for the safety of the vehicle. Any passenger whose conduct is in breach of statutory regulations or whose conduct or condition is in the opinion of the driver a danger or potential danger to the vehicle or its passengers may be removed from the vehicle or prevented from boarding on the driver’s authority.

6.10 The customer will be responsible for any damage caused to the vehicle by the customer or any person travelling with the customer.

7. Exclusion of Liability

7.1 Secure Airparks does not accept any responsibility of liability (whether as bailee or otherwise) for any theft, loss or damage to:

  1. any personal property or loose items left within the vehicle whilst on Secure Airparks premises (whether or not during the Parking Period) or:
  2. for any personal property (including travelling luggage) of the customer or any persons travelling with the customer either when on Secure Airparks premises or at the airport.

7.2 Secure Airparks does not accept any responsibility or liability (whether as bailee or otherwise) for any damage to the windscreen or any other glass in the vehicle or mechanical failure.

8. Complaints Procedure

8.1 Nothing in this procedure restricts the customer's right to pursue remedies through the Court.

8.2 Secure Airparks will acknowledge the customer’s complaint in writing within 5 working days.

8.3 Subject to receiving the customer’s co-operation in supplying any additional information which is required in relation to the complaint and (if required) the vehicle being made available for inspection Secure Airparks will deal promptly with the complaint.

8.4 A complaint will initially be dealt with by Secure Airparks customer Services Department.

8.5 Secure Airparks' customer Service Officer will endeavour to give a written decision in respect of the complaint within 30 days of receiving the same. This period may need to be extended in the event of any delay in the customer supplying further information which is required or there being a delay in the vehicle being made available for inspection.

8.6 In the event of a complaint relating to alleged damage to a vehicle the customer will make the vehicle available for inspection by Secure Airparks to any repairs being carried out thereto.

8.7 Any communication in relation to the complaint can be made by e-mail with the Company’s Customer Services Officer (“CSO”) at complaints@secureairparks.com by using the customer Service number 0131 33 33 377 or in writing addressed to the CSO at the administration address (see 2.5 above).

8.8 All telephone call to Secure Airparks are charged at the rate agreed with your telephone provider. Telephone call may be monitored.

9. Miscellaneous

The paragraph headings do not form part of these conditions and shall not be taken into account in the construction or interpretation thereof.

10. Jurisdiction

10.1 The contract between Secure Airparks and the customer and any person travelling with the customer shall be governed by the laws of Scotland and these conditions shall be constructed in accordance with the laws of Scotland and the parties hereby consent to the exclusive jurisdiction of the Courts of Scotland.

11 Prohibited Activities:

  • No vehicle shall be towed into the car park or enter otherwise than under its own mechanical power and no work or repairs or maintenance to or washing of or cleaning of vehicles by you or anyone on your behalf shall be done in the car park.
  • No activity in connection with the selling, hiring or other disposal of the vehicle shall be carried out in the car park.
  • No commercial activity shall be conducted from any vehicle within the car park.
  • No vehicle shall obstruct any access or circulation area within the car park.
  • No vehicle shall park other than within the spaces designated for parking.
  • No person shall do anything in the use of the car park that may be a nuisance or inconvenience us or any other user of the car park.
  • No vehicle shall cause any unnecessary noise, vibration or exhaust fumes within the car park.
  • No vehicle shall be parked so as to take up more than one space designated for parking.
  • No person shall do any act or thing which may render valid or void any policy of insurance effected in respect of the car park.
  • No person shall park in spaces designated as being reserved unless entitled to do so.
  • No person shall deposit any rubbish, litter or refuse of any kind in the car park, other than in proper receptacles provided for the purpose.
  • No person shall pour or transfer petrol or other fuels into or out of the fuel tank of any vehicle.

What Information is Secure Air Parks gathering about its visitors and how is it being used?

Every computer connected to the Internet is provided with a domain name (e.g. earthlink.net) and an IP Address (e.g. 192.164.13.145). When a visitor requests a page from within the Secure Air Parks website, our Web Servers automatically identify and log the HTTP request that is made to our Web Server. This information reveals nothing personal about you. In fact, the only information that we automatically gather and log is as follows:

  • The IP Address of the Site that may have Referred you.
  • Your IP Address
  • The Web Page that you may have linked to us from, if any.
  • The Product Identifier for Version and Make of Browser (e.g. Internet Explorer 6.0)
  • The Operating System platform that you may be running (e.g. Macintosh or Windows)
  • Search Words or Terms that are passed from a Search Engine (e.g. Google, Yahoo, or Lycos)

There is absolutely nothing special about the information just described, and the practice of collecting this data has been generally standardized by virtually every Web Server on the Internet today.

The purpose for this information is actually two-fold. One, Secure Air Parks has found it advantageous to examine visitor traffic in its aggregate, so that we can ensure maximum compatibility for the various Browsers and Operating Systems that visit our site. Additionally, as any business should attest, it is our desire to generate greater amounts of visitor traffic. By analyzing visitation patterns, referring URLs and Search Engine terms, we can strategically enhance our exposure on the Internet.

What about Cookies?

Cookies are small pieces of data that are transferred to your computer's hard drive through your Web browser from our Web Server. A cookie cannot read data from your hard disk or read cookie files that may have been created from other sites. The Secure Air Parks website utilizes cookies as a means of providing personalization features to our visitors. For example, we utilize cookies to remember settings that you may have made at our website.

You can choose whether to accept cookies by changing the settings of your browser. Typically, by accessing the browser's help feature you can obtain information on how to prevent your browser from accepting all cookies or to notify you when a cookie is being sent. If you choose not to accept these cookies, your experience at our website and other websites may be diminished and some features may not work as intended.

What other information does Secure Air Parks request?

We may also request your e-mail address or mailing address for the purposes of conducting a survey, adding you to our mailing list, or by your request to have someone contact you for additional information. Whenever we request the identity of a visitor, we will clearly indicate the purpose of the inquiry before the information is requested. We maintain a strict "No Spam" policy that means we do not intend to sell, rent, or otherwise give your e-mail address to a third-party, without your consent.

In addition, Secure Air Parks will not send you e-mail that you have not agreed to receive. If you are a member of our Mailing List, you will be contacted with announcements, news, portfolio additions, and new products or services. You have the option of "Unsubscribing" from our Mailing List at any time, thereby disabling any further such e-mail communication from being sent to you. If you wish to have specific communications with a member of the Secure Air Parks staff, you will be required to provide specific information that will be routed to the appropriate contact within Secure Air Parks.

Will Secure Air Parks disclose the information collected to Third Parties?

Secure Air Parks will disclose your personal information or any of its log file information when required by law or in the good-faith belief that such actions are necessary to:

  • Conform to the edicts of the law or comply with a legal process served on Secure Air Parks.
  • Protect and defend the rights or property of Secure Air Parks, or visitors of Secure Air Parks.
  • Identify persons who may be violating the law, the legal notice, or the rights of third parties.
  • Cooperate with the investigations of purported unlawful activities.

Secure Air Parks uses reasonable precautions to keep the information disclosed to us secure. Secure Air Parks reserves the right to transfer information in connection with the sale of all or part of Secure Air Parks capital stock or assets to any third party. Furthermore, we are not responsible for any breach of security or for any actions of any third parties that receive the information. Secure Air Parks also provides "links" to a wide variety of other web sites on the Internet. We are not responsible for their Privacy Policies or how those web sites manage information about their users. We strongly urge you to check with those web sites to determine their privacy policy.

Any changes to this Privacy Policy will be posted on this page so that you are always aware of the information that we collect, how we use it, and under what circumstances we disclose it.
